We highly encourage our customers to review this document periodically for updates.
Terms Used in this Document
- A Customer refers to a Pool Professional who has purchased and/or is using the Pool Notes Tools to store and manage his or her business information. Customer Information refers to the Pool Professionals contact, billing, and/or any other private information stored on Pool Notes LLC systems.
- A Client is a service account belonging to a Pool Notes Customer. Client Information refers to the service account contact, billing, and/or service information stored on Pool Notes LLC systems.
- A Delinquent Account refers to an account that has lapsed on payment for 30 days or less. An account is considered Delinquent starting on the day following the expiration of its paid subscription. For example, an account that is paid through April 15th, 2015 will be considered Delinquent starting on April 16th, 2015.
- A Terminal Account refers to an account that has lapsed on payment for more than 30 days. An account is considered Terminal starting on the 31st day following the expiration of its paid subscription. For example, an account that is paid through April 15th, 2015 will be considered Terminal starting on May 16th, 2015.
Terms of Use
Information stored on and using the Pool Notes tool sets is the sole property and responsibility of the owning Customer. Pool Notes LLC employees do not access any Client Information stored on or using Pool Notes tools. Pool Notes LLC is not responsible for any Client Information problems including, but not limited to, typos, misspellings, incorrect information, and/or missing information.
Pool Notes LLC maintains weekly backups of all Customer and Client Information in case of catastrophic system malfunctions. Pool Notes LLC will only restore Customer and Client Information using these backups in the case of total information loss. If a Customer terminates their account with Pool Notes LLC, all of their Customer and Client information will be removed from all Pool Notes LLC systems. This includes the removal of any backups.
Pool Notes LLC is not responsible for any comprimised Customer or Client Information as the result of any electronic attack.
DO NOT store any Credit Card, Medical, or Private Personal information on Pool Notes systems.
Pool Notes LLC is not responsible for reminding Customers about their subscription lengths or durations. Pool Notes LLC is not responsible for any lapses in Customer accounts. Pool Notes LLC will take the actions described in these Terms of Use for any Customer account that lapses due to lack of payment.
Delinquent Accounts will have their Client Information retained during the delinquency period. If a Customer wishes to renew their subscription, their Client Information will be immediatly accessible.
Terminal Accounts will have their Client Information removed from all Pool Notes systems, including any and all backup information. If a Customer wishes to renew their subscription, they will have to go through the setup process as if they were a new Customer.
